Fair Usage Policy
This Fair Usage Policy (“Policy”) forms part of the FieldEdge Terms of Service and applies to all users of the FieldEdge platform, including the mobile applications, HQ Dashboard, and associated services (collectively, the “Service”).
The purpose of this Policy is to ensure that the Service remains reliable, performant, and commercially sustainable for all customers.
While FieldEdge subscription plans may include generous or “unlimited” usage, all usage remains subject to this Fair Usage Policy.
References to “unlimited” usage in marketing materials or plan descriptions refer to reasonable usage consistent with the intended scope of the subscription plan and remain subject to this Policy.
A subscription provides access to the Service subject to applicable policies, including this Fair Usage Policy. It does not guarantee the availability of unlimited infrastructure resources or third-party service capacity.
1. Principle of Fair Use
FieldEdge plans are designed to support real-world field organizing activities, including canvassing, volunteer engagement, phone banking, and campaign operations.
Because the Service operates on shared infrastructure and relies on certain third-party technologies, usage must remain within commercially sustainable levels.
FieldEdge reserves the right to determine, in its reasonable discretion, whether usage exceeds fair use levels for the applicable subscription plan.
Usage may exceed fair use even where the customer is using the Service for legitimate campaign purposes and in accordance with the intended functionality of the platform.
2. Factors Considered in Assessing Usage
In determining whether usage exceeds fair use levels, FieldEdge may consider factors including, but not limited to:
the customer’s subscription plan
number of active or simultaneous users
size of the customer’s NationBuilder database
campaign scale and geographic footprint
frequency and intensity of mobile application usage
volume of mapping or geolocation activity
frequency of synchronization or API interactions
infrastructure, hosting, or bandwidth consumption
usage of third-party services integrated into the platform
operational impact on FieldEdge systems or other customers
FieldEdge may also compare usage against typical usage patterns of customers with similar subscription plans, campaign structures, or database sizes.
3. Third-Party Services
Certain features of the Service rely on third-party technologies and infrastructure providers.
These may include, for example:
mapping and geolocation services
cloud hosting infrastructure
synchronization services
monitoring and analytics tools
Customer usage of these services may generate variable costs for FieldEdge.
Where customer usage results in materially increased third-party or infrastructure costs, FieldEdge may determine that such usage exceeds fair use levels for the applicable subscription plan.
In such cases, FieldEdge may introduce reasonable usage-based charges or require a revised pricing arrangement for the continued use of those services.
4. Examples of Usage That May Exceed Fair Use
Without limiting the generality of this Policy, usage may exceed fair use where it:
a. Disproportionate resource consumption Consumes a materially disproportionate share of Service resources compared to typical usage patterns for customers on similar plans.
b. High-cost operational usage Generates unusually high operational or third-party service costs relative to the customer’s subscription.
c. Deployment beyond plan scope Reflects a campaign scale, operational intensity, or deployment profile significantly beyond what the applicable subscription plan is intended to support.
d. Operational strain on shared systems Places unusual demand on shared infrastructure or negatively impacts system reliability, performance, or availability.
e. Technical misuse Includes automation, scraping, scripted access, attempts to bypass safeguards, or other conduct prohibited by the Terms of Service.
For clarity, usage may exceed fair use even where the customer is using the Service in good faith and for legitimate campaign purposes.
5. Monitoring and Usage Analysis
FieldEdge may monitor and analyze usage patterns to ensure compliance with this Policy and maintain system performance, reliability, and security.
Monitoring may include analysis of:
application activity
infrastructure utilization
API usage
mapping and geolocation requests
synchronization activity
system performance metrics
All monitoring and processing of such information is conducted in accordance with the FieldEdge Privacy Policy.
6. Actions in Case of Excessive Usage
If FieldEdge determines that a customer’s usage exceeds fair use levels, FieldEdge may, in its reasonable discretion:
contact the customer to discuss usage patterns;
request that usage be reduced or modified;
introduce usage-based charges for services that generate disproportionate infrastructure or third-party costs;
require migration to a higher subscription tier or enterprise plan;
require a custom or negotiated pricing arrangement;
implement technical safeguards such as throttling or rate limiting;
limit or restrict specific features of the Service; or
suspend access to specific functionality where necessary to protect the Service.
Where reasonably practicable, FieldEdge will seek to notify the customer and work toward a commercially reasonable solution before restricting access.
However, FieldEdge is not obligated to continue providing usage levels that it considers excessive or commercially unsustainable under an existing subscription plan.
7. Monthly Subscriptions
Where a customer is on a monthly subscription plan, FieldEdge may notify the customer that their usage exceeds fair use levels and require migration to a higher tier plan, enterprise arrangement, or revised pricing model beginning with the next billing period.
If the customer does not agree to the revised arrangement, FieldEdge may limit or suspend the specific functionality responsible for the excessive usage.
8. Prepaid Subscription Periods
Where a customer has prepaid for a quarterly or annual subscription period, FieldEdge will generally not modify the base subscription fee during the active subscription term.
However, if usage during the subscription period materially exceeds fair use levels, FieldEdge may:
introduce reasonable usage-based charges for services that incur significant third-party or infrastructure costs;
implement technical limitations on specific features responsible for disproportionate usage; or
require migration to a different plan at the next renewal period.
FieldEdge will use reasonable efforts to notify the customer and work toward a mutually acceptable arrangement.
9. Enterprise or Custom Agreements
Where a customer has entered into a separate written enterprise or custom agreement with FieldEdge, the terms of that agreement will prevail to the extent of any inconsistency with this Policy.
However, unless expressly stated otherwise in such agreement, the principles of fair use described in this Policy will still apply.
10. Policy Updates
FieldEdge may update this Fair Usage Policy from time to time to reflect changes in infrastructure costs, third-party services, or product functionality.
Updated versions will be published on the FieldEdge website and will take effect upon publication unless otherwise stated.
